Earthly Ltd. Referral Program Terms and Conditions
By participating in the Referral Program, you (the “Referrer”) agree to abide by these Referral Program Terms & Conditions.
Definitions
Referrer: you, a registered Earthly customer.
Referred Contact: a Head of Sustainability, CEO or other decision-maker, from a company of over 50 people, with whom Earthly has not previously been in contact per our Hubspot database and to whom the Referrer recommends Earthly.
Qualified Business Contact: A Referred Contact that has been reviewed and qualified by Earthly, based upon their role within the business and level of intent.
About Our Referral Program
Overview
Customers can recommend business to Earthly. For each new Qualified Business Contact that meets with our Sales team, Earthly will invest £50 on behalf of the Referrer and, upon completion of a transaction with Earthly, £50 on behalf of the Referred Contact’s company in the nature-based solution of their choice from the Earthly marketplace (the “Referral Reward”).
For the Referrer
To qualify for the program, (i) you must refer only valid business owners and managers (ii) they must submit their details via the online form and schedule a meeting with the Earthly Sales team, and (iii) they must meet with the Sales team online or in-person for a duration of not less than 30 minutes.
The investment amount is non-transferable, not valid for cash or cash equivalent, and cannot be combined with other offers. Referrers are responsible for any and all tax liability resulting from any Referral.
Following the Rules
Earthly reserves the right to review, investigate, and disqualify any Referrer that seeks to abuse the Referral Program, such as attempting to gain through self-referral by using a different email address, or distributing via commercial advertising or spam. Earthly may delay any Referral Reward for the purposes of investigation and may refuse to verify and process any transaction for any reason.
Referrers must comply with all up-to-date “SPAM” laws and marketing regulations, which may include the laws where the intended Referred Contacts live. For example, emails must be created and distributed in a personal manner and bulk email distribution is prohibited. Any distribution that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited.
Eligibility
Eligibility is limited to current Earthly customers only. The Referral Program cannot be used by businesses for affiliate lead generation without the express written consent of Earthly.
Privacy
The Referrer acknowledges that some of their personal information may be sent to the Referred Contact as confirmation of the Referred Customer seeking to engage with Earthly. Accordingly, Earthly strongly advises that Referrers only refer someone whom they know, trust, and have previously spoken to. Any personal information collected, processed, and used as part of the Referral Program, including that of the Referrer and Referred Contact, will be used in accordance with Earthly's Privacy Policy.
Right to Close Accounts
Earthly is not responsible for errors, omissions, malfunctions, interruptions, deletions, delays or failures of operations. Earthly reserves the right to close the account(s) of any Referrer and/or Referred Contact and to request proper payment if the Referrer and/or Referred Contact attempts to use the Earthly's Referral Program in a questionable manner or breaches any of these Terms & Conditions or is in violation of any law, statute or governmental regulation. All of Earthly’s decisions are final and binding, including decisions as to whether a Referred Contact is qualified to a Qualified Business Contact.
Right to Cancel Program or Change Terms
Earthly reserves the right to cancel the Referral Program or to change these Terms & Conditions at any time in its sole discretion. The Earthly Referral Program is subject to modification or termination at any time without notice at Earthly’s sole discretion. All Referrals will expire six months from the date of submission, unless otherwise notified by Earthly.
Customer Agreement
The Terms and Conditions of the Referral Program are in accordance with the Earthly Supply of Services Agreement, where applicable, and/or our Terms and Conditions as specified on the Earthly website (the “Customer Agreement”). Payment terms, governing law in case of a conflict, and other terms outlined in the Customer Agreement remain applicable.
